If your state uses a point system to evaluate driving records, you may find yourself wondering if a ticket for violation of child safety seat laws will add points to your record.

States vary in their interpretation of how many points are added to your driving record for failing to properly restrain a child. States which only add points for moving violations do not give points for a child safety seat ticket, since this is not a traffic offense. However, an increasing number of states are deciding to penalize drivers for non-moving violations if they represent a safety hazard. In New York, for example, a child safety seat violation adds three points to your driving record. This is the same penalty for any passenger safety violation, including a seat belt ticket. California gives you one point on your driving record for a safety seat violation, even if the ticket occurs when you are traveling in another state.

Consequences of Too Many Points

What does it mean to have points added to your driving record for a child safety seat violation? If you've never had any other tickets or been involved in a vehicle accident, it is unlikely to be a cause for concern. If you have points on your driving record for other offenses, however, you may have your driving privileges suspended or revoked. Florida gives you three points on your driving record for a car seat violation, the same penalty you'd receive if you had an open container of alcohol in your vehicle. If you accumulate 12 points in a 12 month period, you'll see your license suspended for 30 days. In addition, serving a point suspension won't prevent your convictions from being used to accumulate additional driver's license suspensions or revocations if you prove to be a repeat offender.

Depending upon your insurance carrier, you may see your monthly premiums increase for getting too many points on your driving record. If you have questions about a car seat violation's affect on your auto insurance rates, however, the best course of action is to contact your insurance agent directly. DMV representatives only enforce state laws and thus won't be able to provide assistance with this issue.
