There is no set driver license reinstatement procedure in New York. The DMV has different reinstatement requirements for each scenario, as determined by state laws, the presiding court and the nature of the suspension. Two of the more common suspended license reinstatement procedures are as follows:Driving Without Insurance
- Serve your suspension time. This is determined by the number of days you did not carry insurance while holding on to your license plates (NY law dictates that you must surrender your plates as soon as your insurance lapses). So if, for example, you held onto your license plates for 124 days while not covered by insurance, your suspension would last 124 days.
- Pay a $50 termination fee and possible other driver license reinstatement fees.
- Provide proof of insurance coverage.
First-Time DWI (21 years old or over)
- Serve your suspension time. Most first-time offenders are hit with a one year suspension.
- Provide proof of enrolling in a Drinking Driving Program.
- Pay the $50 termination fee and possible other drivers license reinstatement fees.
NOTE: Requirements may vary based on other circumstances during the time of your DUI arrest. For instance, your blood alcohol count (BAC), or whether there were children in the vehicle could also necessitate additional reinstatement steps.
Other possible suspended license situations include:- Having a mental or physical condition.
- Excessive points on your driving record.
- Committing three or more speeding or misdemeanor traffic violations over an 18-month period.
- Failure to submit to re-examination tests following three accidents in six months.
Keep in mind that because every revoked license case is different, some reinstatement situations may also include re-taking the driver license tests (vision, written, road).
