Title Transfer Between Family Members

Completing a car title transfer from family member to family member within California is straightforward. Family members are allowed to transfer titles to each other and not pay use tax or get a smog check.

First, family members the DMV recognizes are:

  • Spouses or domestic partners
  • Siblings or children
  • Parents or grandparents

You have to complete your auto title transfer within 10 days of the day you get the vehicle. To do so, follow these steps:

  1. Get the old owner to sign off on the car title and give the title to you. (You may want to get a bill of sale as a receipt. It’s not required, though.)
  2. Write down the mileage in the odometer reading section, if the car is 10 years old or newer.
  3. Get a smog and tax exemption by filling out Statement of Use Tax Exemption (REG 256). This form is available on the CA DMV Web site.

If the car title is so old that it doesn’t have a place to write down the mileage, you will need to get the Vessel Transfer and Reassignment Form (REG 262) and write the mileage down on here. Both of you must sign. Get the form by calling the DMV at (800) 777-0133. The automated system will mail it to you. This form is not available for Internet download. You can also get it at a CA DMV office.

Lost Title?

When the title is lost or mutilated, you and the old owner must both sign and notarize an Application for Duplicate Title. This form is available from the CA DMV Web site. You can use this notarized form to get yourself a new title in your name. You do not need a bill of sale.
