The emissions testing requirements you must meet before you transfer the title depend on whether you're the seller or the buyer.

Seller's Emissions Testing Requirements

You are not required by law to have the vehicle that you're selling pass an emissions exam prior to the title transfer. New York's vehicle registration laws place inspection responsibility on the buyer. Your focus should only be on signing over the car title and producing a bill of sale. 

Buyer's Emissions Testing Requirements

If you're the buyer, take your newly purchased car to an inspection center for emissions testing. It's part of the New York registration process. Any inspection certificate issued to the previous owner immediately becomes invalid after you register the vehicle under your name.  You'll have 10 days from the date you applied for a vehicle registration and title to take the car to a DMV-approved inspection center for an emissions exam. 

If the vehicle passes the inspection, an emissions decal will be affixed to the windshield. This will indicate to law enforcement that your vehicle is in compliance with NY smog laws. If you're caught driving without an emissions decal, you may be fined.
