Smog, Emissions, and Titles 

Only the buyer needs to worry about emissions testing; as dictated by New Jersey smog check and safety inspection laws, it becomes his or her responsibility as soon as he or she applies for vehicle registration.

As the seller, you are not required to take the vehicle in for a smog check prior to the title transfer. If the vehicle is registered in New Jersey, it will be proof enough that it passed emissions testing within the last two years. Before handing over the car title, you're only required to:

  • Remove the license plates. If you don't transfer them to another vehicle (owned by you) you must surrender the plates to any NJ MVC office.
  • Sign over the title in a timely fashion. You must transfer the title to the buyer within 10 days of the sale date or face a $25 penalty.

You're not required to produce a bill of sale. You should, however, for peace-of-mind purposes, keep one on file. Though you'll probably never need it, you'll be glad you have it if a situation arises requiring the bill of sale.
