Pennsylvania toes the line between total safety laws for helmets and letting people have the right to chance their skulls to the asphalt, if they desire. Keep in mind that motorcycle riding is safest when helmets are worn for protection and that your insurance may see a break if you do decide to always wear a helmet.All motorcycle permit holders, regardless of age, must wear helmets. So must their passengers.
A three-wheeled motorcycle rider with an enclosed cab is exempt from wearing a helmet.
After that, it’s up to age.
Younger than 21
You must wear a helmet while riding motorcycles, scooters, or mopeds. The passenger of a moped, scooter, or motorcycle must also wear a helmet.
21 and Older
You and your passenger may skip the helmet if you:
- Are over age 21. Note that your passenger may be younger than this age.
- Have held a motorcycle license (Class M) for two or more years.
- Passed a motorcycle safety class sanctioned by PennDOT or the Motorcycle Safety Foundation.
