Filing Lemon Law Claims in New York

The manner in which you file a claim for a lemon car slightly varies depending on whether you bought the vehicle new or used.

Filing for Used Cars


If you bought the car used you can file a claim if:

  • The dealership fails to repair your vehicle after three attempts, or,
  • The vehicle has been out of service, due to repairs, for a cumulative total of 15 days or more
To file a clam, complete a Used Car Lemon Law Request for Arbitration Form (found on NY Attorney General's website). Then gather your:

  • Purchase or lease agreement.
  • Used car warranty.
  • Work and repair orders from the dealership and/or mechanic.
  • Any correspondence between you and the dealership.

The Attorney General’s office will review your case and then notify you if your claim has been accepted or rejected. If it is accepted, you'll be required to submit a $120 filing fee.

Filing for New Cars


You can file a claim if:

  • After taking the vehicle in for auto repair, the dealership or manufacturer failed to fix the problem after four or more attempts, or,
  • The vehicle has been out of service, due to repairs, for a cumulative total of 30 days or more.
