North Carolina Lemon Laws for New Cars
The North Carolina Lemon Law doesn’t cover used cars; it only covers new cars. In addition to passenger vehicles, falling under this legal umbrella are motorcycles, pick-up trucks, and certain vans.Under this law, which also goes by the name of the New Motor Vehicles Warranties Act, a vehicle manufacturer must repair any defects that jeopardize the vehicle's value, use and/or safety within the first 24 months or 24,000 miles (whichever comes first).
In NC, your vehicle becomes a lemon if:
- The problem is covered under the manufacturer's warranty.
- You notify the manufacturer of the defect in writing and give the manufacturer no more than 15 days to have an auto repair mechanic correct the problem.
- There have been four or more attempts to fix the problem but it still exists. Or, the vehicle has been out of service for a cumulative total of 20 or more business days within a 12-month period.
- The full contract price, including but not limited to, undercoating charges, installed options, and non-refundable portions of extended warranties and service contracts.
- All upfront charges that may include sales tax, license, and registration fees.
- All finance charges you paid after first reporting the problem.
- Any incidental damages, minus a reasonable allowance for vehicle use.
