Filing a Lemon Law Claim in New Jersey

Follow these steps to file a claim if you think you’re car is a lemon; they apply to both new cars and used cars:

  1. Complete a Lemon Law application. Submit it to the New Jersey Lemon Law Unit along with all pertinent documents including:
    • Photocopies of all auto repair invoices and any other correspondences with the mechanic.
    • Towing or rental car receipts.
    • Vehicle purchase order.
    • Certified letter to the manufacturer.
    • Certified mail return receipt.
    • Retail installment contract.
    • Lease agreement.
  2. The Lemon Law Unit will review your case. If it decides your car qualifies for Lemon Law protection, you'll be asked to submit a $50 application fee. If you win your case, this fee will be returned to you as part of the amount awarded.
  3. After the fee is received, the Lemon Law Unit will contact you to pinpoint a hearing date before a judge at the Office of Administrative Law.
  4. After the case has been heard, a decision will be made within 20 days of the hearing.
  5. The Director of the Division of Consumer Affairs can accept, reject, or modify the judge's decision within 15 days. If the Director takes no action, the decision of the judge becomes final.
  6. If the ruling is in your favor you will receive the agreed upon settlement.
