Illinois Lemon Laws for New Cars

The Illinois Lemon Law only applies to new cars (leased or purchased). Vehicles falling under this category include:

  • Recreational vehicles (excluding trailer).
  • Light trucks and vans weighing less than 8,000 pounds.
  • Vehicles purchased in Illinois.
  • Vehicles in their first 12,000 miles or 12 months (whichever comes first).
Vehicles not covered under the IL Lemon Law include:

  • Used cars.
  • Motorcycles.
  • Boats.
  • Altered or modified vehicles.
For your vehicle to be classified as a lemon it needs to meet the following criteria:

  • Must have a defect that alters the vehicle's use, value and/or safety, and after FOUR auto repair attempts by a mechanic it still remains a problem.
  • The vehicle must be out of service for a minimum of 30 days.
