Filing a Lemon Law Claim in Illinois

Before you attempt to file a lemon car claim, make sure it qualifies. Used cars do not qualify; only new cars that meet the following criteria can be covered under the Illinois Lemon Law:

  • It has been out of service for a minimum of 30 days.
  • It possesses a defect that jeopardizes the vehicle's use, value and/or safety, and remains a problem after four auto repair attempts by a mechanic.
  • It was purchased in Illinois.
If your vehicle qualifies, you must initiate a lemon claim within the vehicle's first 12,000 miles or 12 months (whichever comes first). You will not be covered if you don't act within this window.

Contact the vehicle's manufacturer, NOT THE DEALER, for lemon law forms and instructions. To aid your defense, be sure to maintain diligent records that help show your car is a lemon. Keep copies of all correspondence with the manufacturer, work orders, and repair receipts.

If the IL Dispute Court rules in your favor, you can expect to receive a replacement vehicle or financial compensation.

Contacting a Lemon Law Attorney

Because the legal process can get complicated, you should give serious consideration to hiring a Lemon Law lawyer.

His or her expertise will go a long way in helping you receive just compensation for your lemon car, and the counsel can be especially beneficial in Illinois, which in addition to Lemon Laws also has complicated federal and state laws dealing with contracts and new products.
