Filing a Lemon Law Claim in Pennsylvania

You can file a Pennsylvania (PA) Automobile Lemon Law claim within the first year that you purchase or lease a car or before you put 12,000 miles on the car. If the manufacturer has an express term warranty, you can file a claim on the lemon car before the warranty expires. PA Lemon Laws apply to new cars and to used cars.

The car must be registered with the PA Bureau of Motor Vehicles. To file a claim on a lemon you must:

  • Contact the automobile manufacturer’s zone representative (representative telephone numbers are listed at the front of most automobile owner’s manuals).
  • If the zone representative does not resolve the issue, ask to speak with the manufacturer’s Dispute Settlement Program manager.
  • Keep detailed records, including receipts, of each auto repair made to the lemon car by a licensed mechanic.
  • Document communications that you make with the automobile manufacturer or their representative. Include the dates and times that you speak with the manufacturer. Also write down the name of the manufacturer’s representative that you speak with and any agreements made between you two, including the date and location that you are to return the lemon in order to have it replaced or to receive a refund.
Should the manufacturer not be to your satisfaction, you can contact a Lemon Law lawyer. The Lemon Law attorney can open a claim to take legal action against the manufacturer.
