In the state of Georgia, all passengers younger than 16 must wear a car seat belt when vehicle speed exceeds 15 mph. Children younger than six must ride in child safety seats.As of May 2010, there is no GA law requiring passengers over the age of 16 to wear seat belts.
Exceptions to the GA Seat Belt Law
Exceptions to the GA seat belt law include:- Drivers or passengers frequently leaving the vehicle when vehicle speed does not exceed 15 mph.
- Drivers or passengers in possession of a physician’s note stating car seat belts should be avoided for medical reasons.
- Drivers or passengers possessing official government documentation stating car seat belts should be avoided for medical purposes.
- Drivers operating vehicles in reverse.
- Drivers or passengers in vehicle models manufactured prior to 1965.
- Passenger vehicles not required by federal law to contain car safety belts.
- Passenger vehicles operated by rural U.S. Mail carriers.
- Newspaper delivery vehicles.
- Emergency service vehicles.
- Public transportation vehicles.
Additional Seat Belt Laws
Additional safety laws regarding seat belt usage include the following:- A child weighing 40 pounds or more is permitted wear a lap belt only, provided there is no functioning shoulder strap available and the child is in the back seat.
- A child taller than 4’9’’ is permitted to wear a lap belt only, provided no functioning shoulder strap is available and the child is in the back seat.
Penalties and Fees for Ignoring the Seat Belt Laws
