New York Child Restraint Laws
Okay, here's the scoop on New York's safety laws as they pertain to child car seats and boosters:- Every child younger than 16 must use a safety restraint.
- Children younger than four must be properly secured in federally-approved baby car seats or child safety seats that are attached to the vehicle by seat belts or universal child restraint anchorage (LATCH) systems. If a child tops 40 pounds, the state will allow for he or she to be restrained in a booster seat with a lap and shoulder belt.
- Kids between the ages of four and seven must be seated in either a booster seat with a lap and shoulder belt or a child safety seat. If all of the combination lap and shoulder belt positions in the vehicle are already occupied by kids using car seats or booster seats, the child who would normally use a booster seat is allowed to ride using only a lap belt.
- Any child in the four-to-seven year old age group who weighs more than 100 pounds or is more than 4’9’’ tall, is also exempt from booster seat mandates. The state will allow for he or she to use a seat belt with a shoulder harness.
- An appropriate car seat must be used until the child's eighth birthday. The seat must be adjusted, as recommended by the manufacturer, to properly meet the child's weight and height. And this car seat, as well as all others, should not be used in the vehicle's front seat.
