Exemptions to NY Child Restraint Laws
Exemptions to New York child safety laws come into play only when a child of a certain age group exceeds a designated weight and/or height.Currently there are two laws with exemptions:
Law: All kids younger than four must be properly secured in federally-approved baby car seats or child car seats that are attached to the vehicle by safety belts or universal child restraint anchorage (LATCH) systems.
Exemption: Any child younger than four years old who exceeds 40 pounds may instead use a booster seat secured with a lap and shoulder belt.
Law: All kids between the ages of four and seven must use either a booster seat secured with a lap and shoulder belt or a car seat.
Exemption: Any kid in this age group who tops 100 pounds or is more than 4’9’’ tall is given the legal green light to use a seat belt that has both a lap belt and a shoulder harness.
Penalties for Ignoring NY Child Restraint Laws
