Obtaining a Medical Exemption from NY Tint Laws

The New York tint law does allow for a medical exemption. To request the exemption you must be either the driver or someone who regularly rides in the vehicle of question.
 
Before applying, keep in mind that the NY DMV, in conjunction with the New York State Health Department, only allows car tint exemptions for the following medical conditions:

  • Porphyria
  • Xeroderma pigmentosa
  • Severe drug photo-sensitivity
If you qualify, or think you do, submit the following documents to the DMV:

  • A completed Application for Tinted Window Exemption (Form MV-80W). You can download this from the NY DMV website.
  • A photocopy of the car's registration certificate.
  • A physician's statement detailing the medical condition that requires for you to be shielded from sunlight. This statement must be composed on the physician's letterhead and must include his or her New York professional license number. Or, if the physician is based outside of NY, the statement must include the state in which he or she is licensed as well as a medical license, registration or certificate number.

After your window tint application is reviewed you may be asked to submit additional information regarding your medical condition. This, depending on your condition, may include a written statement from a dermatologist or an optometrist.

New York Window Tinting Laws

If you're unfamiliar with the state's tinting restrictions, they are as follows:

Darkness of Tint


  • Windshield: Non-reflective tint is allowed on the top six inches of the windshield.
  • Front side windows: Tinting must allow more than 70% of light through the window.
  • Back side windows: Auto tinting must allow more than 70% of light through the window.
  • Rear window: No car tint restrictions.

Reflective Tint


The NY tint law bans metallic or mirrored reflection on front side windows and back side windows.  

Miscellaneous Window Tint Requirements


  • Restricted colors: No restrictions.
  • Side mirrors: Side mirrors are mandatory if the rear window is tinted.
  • Sticker requirements: New York requires each tinted window to display a sticker identifying legal tinting. This must be affixed between the film and glass.
  • Medical exemption: Medical exemptions for special tinted windows require permission from the DMV.

Tinted Windows and Your Car Inspection

Despite the safety laws, a New York inspection mechanic cannot fail your vehicle for illegal tinting. Window tinting is not part of the inspection process. He or she can point out that it's illegal, but otherwise tinting cannot have bearing on your vehicle registration inspection.
 
This should not, however, be interpreted as ticket immunity. If your car tint exceeds NY standards the police will ticket you. Many officers now carry tint meters for measuring light transmittance through tinted windows.
