Car Seat Belt Use in Conjunction With the Illinois Seat Belt Law
The Illinois seatbelt law mandates the following usage:
All occupants, regardless of age, riding in the front seat must wear seat belts or, in the case of kids younger than eight, be properly secured in a state- and federally-approved child safety seat.
All kids younger than 16, regardless of front or back seat position, must be secured by seat belts or proper restraint systems (child safety seat, booster seat) as dictated by the IL Child Passenger Protection Act.
If the driver is younger than 18, all passengers younger than 19 must be buckled, regardless of seating position.
If the driver is older than 18 all back seat riders younger than 16 must wear seat belts.
Seat Belt Safety Laws and Exemptions for Car Seat Belts
Exemptions to the safety laws related to car seat belts apply to the following situations:
Adults seated in the back seat.
A driver driving in reverse.
Anyone driving in a car manufactured in 1965 or before.
On-duty rural mail carriers.
Any driver with a medical condition which makes donning a seat belt unsafe. Either a doctor's note or an endorsement on the license is required for exemption status.
Any delivery driver making frequent stops, provided the vehicle does not exceed 15 mph.
Penalties for Violating Illinois Seat Belt Law
Getting caught riding without a seat belt comes with a $55 fine.
