Exemptions to the Pennsylvania Child Safety Seat Law
Child safety seat laws in Pennsylvania (PA) are administered by state troopers, police officers, and administrators at the Pennsylvania Department of Transportation (PennDOT). The purpose of the child car seat laws is to ensure that minors in PA are adequately protected while they are transported in vehicles operated in the state.Exemptions to the PA car seat laws are based upon the child’s age, height, and weight. These exemptions regarding baby car seats and child car seats in PA state that:
- You are not required to use a booster seat for a child who is four years or older if the child weighs at least 40 pounds.
- If you have an older vehicle that was not designed with a shoulder strap, you can use a federally approved child safety seat to secure the child in the car. You must place the seat and the child in the car according to manufacturer specifications. You are not required to secure the seat with a shoulder strap.
- Children between four and seven years old who weight at least 80 pounds are permitted to be secured in a vehicle using an adult seat belt. The child must be at least four feet and nine inches tall.
Medical Exemptions
PA child restraint laws allow for medical exemptions as well. To receive a medical exemption from using car seats, you must:
- Contact PennDOT to receive the form that your child’s physician must complete.
- Submit a written certification from your child’s physician to PennDOT.
- Make sure your child’s physician’s name and medical office address, and your child’s name, weight, and age are included on the form.
- Specify the reason for the exemption from the standard safety laws; the physician is also required to provide the length of time that your child should be exempted from meeting the standard PA child car safety seat requirements.
