About the Pennsylvania Seat Belt Law

State troopers and police officers in the state of Pennsylvania (PA) reinforce the seat belt law in the Keystone State. The Pennsylvania Department of Transportation (PennDOT) is responsible for communicating laws regarding seat belts to PA residents, drivers, and out-of-state vehicle owners who operate a vehicle in PA.

Child seat safety laws fall under the PA seatbelt law. Parents, school bus drivers, public transportation vehicle operators and all PA residents who operate a vehicle in the state are required to abide by the car seat belt laws.

Safety Laws for Children Younger Than Eight Years Old


  • Children younger than four years old must be securely fastened in an approved manufacturer’s child safety seat.
  • Children between four and eight years old are required to be secured in a booster seat if they weigh fewer than 40 pounds. An adult car seat belt must secure the booster seat into place.
  • Vehicle operators are responsible for ensuring that the booster seat is placed in the vehicle according to manufacturer specifications.

Car Seat Belt Laws for Persons Eight to 17 Years Old


  • Minors aged eight through 17 years must use a seat belt wherever they are placed in a vehicle operated within PA.
  • Adults of all ages are also required to wear a seat belt whether they are a driver or a passenger.

Penalties for Ignoring the Seat Belt Law

If passengers eight through 17 years are not properly secured using car seat belts while they are transported in a vehicle operated in PA, the driver can be assessed a $60 fine. Drivers can receive a $100 fine if they operate a vehicle in PA that a child under the age of eight years is not properly secured in.
