Car Seats and Safety Laws

Each state has its own laws requiring children using child car seats and baby car seats. Some have higher age limits than others. Usually, the state’s car seat laws are on the state website, or at least linked to from the state website, as is the case in New York and North Carolina.

A few states have car seat laws on their law enforcement websites. For example, California lists its car seat laws on its California Highway Patrol website.

NHTSA Recommendations

In any case, if you cannot find your state’s car seat laws, then the National Highway Safety Administration (NHTSA) has a car seat guide in its “4 Steps for Kids” campaign. This is a visual guide that tells you exactly what car seat to buy for your age and weight of child. Using this guide will ensure that you use the right baby car seat and are following car seat laws, because the NHTSA uses only standards that meet or exceed the strictest state’s requirements.

The NHSTA also has Child Passenger Safety starred ratings for car seats that meet or exceed child restraint laws. The stars range from one (poor feature) to five (excellent child restraint features).

NHTSA Child Safety Seat Inspections


The NHTSA estimates that a whopping three out of four parents do not properly install their car seats. They have inspection stations, usually at hospitals, health centers, police or fire stations, which will look at your car seat and make sure it’s properly installed. Sometimes there are also inspection events.
