What restrictions apply to new and teen drivers with a DE drivers license?

New Driver Checklist
As a Delaware learners permit holder, you'll face significant driving restrictions. However, these restrictions lessen over time.

DE Drivers Permit Restrictions: Initial Six Months

  • You must always have the permit with you when you're driving.
  • A properly licensed parent, guardian, or other licensed driver (approved by the sponsor) must be positioned in the front passenger seat when you're driving.
  • The supervisor must be least 25 years old and a Class D license holder for a minimum of five years.
  • When you're driving, everyone in the car must be secured by either a safety belt, child safety seat, or booster seat (as declared appropriate by Delaware law).

DE Drivers Permit Restrictions: After Six Months

  • You may drive without supervision between 6 a.m. and 10 p.m.
  • You may drive after that time period with proper supervision (see above), or if you're going to and from work, church activities, or school activities held on school property.
  • When you're driving unsupervised, only one passenger may ride with you (this limit doesn't apply to family members).

Teens Beware

As a teen, you may think it's not a big deal to occasionally bend these restrictions. But, if you're caught doing so by law enforcement, you'll face a two-month permit suspension. The state considers violating permit restrictions to be driving without a drivers license, so it's a serious offense.

If you're nailed for breaking the permit restrictions again, you'll be hit with a four-month permit suspension.
