New and Teen Driver Restrictions in West Virginia

Because West Virginia is one of the several states with a Graduated Driving Licensing (GDL) program, let’s look at the driving restrictions for each of those steps, shall we?

Level I Instruction Permit


With this drivers permit, you:

  • May only drive between 5 a.m. and 10 p.m.
  • Must have a licensed driver who is 21 or older in the front passenger seat.
  • May only have two passengers who aren’t family members in the vehicle with you (in addition to the 21-year-old or older supervising passenger).
  • Must make sure all your passengers are wearing seat belts.
  • Absolutely may not use a cell phone for talking or texting while you’re operating the vehicle. Police officers can stop you for this as a primary offense.
  • Must abide by the state’s zero alcohol tolerance policy.

Level II Intermediate License


With your intermediate driver license, you may drive between 5 a.m. and 10 p.m. without a licensed driver 21 or older.

However, you:

  • Must have a licensed driver who is 21 or older with you between 10 p.m. and 5 a.m. unless you’re on your way to or from your job or a school or religious function, or it’s an emergency involving the possible injury or death of another person.
  • Must have no non-family passengers younger than 20 during the first six months, and only one non-family passenger younger than 20 during the second six months.
  • Must make sure all your passengers are wearing seat belts.
  • Still can’t use your cell phone for talking or texting while you’re driving.
  • Still must follow the state’s zero alcohol tolerance policy.

Level III Full Class E License


You might think you’re home free with a full drivers license, but there are still some restrictions:

  • The zero alcohol tolerance policy still exists.
  • All your passengers must be buckled up.
Plus, now that you have a full license, you can expect DMV points to be placed on that license for any tickets you receive.

First-Time Drivers 18 and Older

The GDL process only applies to teens younger than 18; however, adults 18 and older also have to obtain a learners permit – WV calls it a Class E instruction permit – before they can obtain a full drivers license, and that driving permit comes with the restriction of always having a licensed driver who is 21 years old or older in the front passenger seat.

Of course, first-time drivers with this permit must hold it for at least 30 days (and up to 90 days, with one renewal option after that) before they can apply for the full Class E license.
