Is it fair not to hire someone because of their driving record?
It may or may not be legal not to hire someone because of their driving record, but issues are of fairness are hotly debated and have led to some states adopting restrictions on when employers can even access driving records.

An increasing number of employers are using driving records in standard background searches of job candidates. In some cases, driving is a requirement of the job and the employer needs to ensure the job candidate is a safe driver. In other cases, driving is not a requirement of the job but the employer uses a driving record to construct a risk model of the job candidate. It is the latter scenario that has raised concerns about fairness. Labor rights advocates argue that considering driving records for jobs that are not related to driving is arbitrary and discriminatory.
