Do DUI penalties include going to jail?
They very well could. Some states have an automatic jail time for DUI (also known as DWI) penalties. Tennessee, for example, imposes at least 48 hours of jail time and up to 11 months for a first time drunk driving offender. If your blood alcohol level (BAC) is .20 or more, you will be put away for at least seven days.
Most states impose different, lesser penalties for first-time DWI offenders. These include a suspended license of six months to a year or more; community service, such as roadside trash pickup on several Saturdays; fines of thousands of dollars; and taking a DUI education class.
For second or third time offenders, expect jail time and more fines and penalties, such as the state taking away your vehicle, prolonged license suspension, and mandatory AA counseling. You may also get a breathalyzer device placed on your car. This device requires you to breathe into it before the car will start; if you’ve had alcohol, it won’t.
