Do DUIs And DWIs count as traffic violations?
No. In most states, DUI and DWI offenses are considered to be crimes - not merely traffic violations. This is a natural progression of the movement of the last decade or so to toughen drunk driving laws.
In Wisconsin, if you're a first-time offender and there's no one under the age of 16 in your vehicle when you were arrested for the DUI, it's classified as a traffic violation. In all other DUI situations within the state, it's a crime.
Don't be confused, though. Even though a DUI offense is categorized as a crime and not a traffic violation, you still will receive points on your driving record for the offense.
If you're arrested on a such a charge, a DUI lawyer can help you interpret the DUI laws in your states, and ensure your rights are protected.
